Customer Advisory: CBSA eManifest House BL Filing for Freight Forwarders & NVOCC’s

Please be informed, the Canada Border Services Agency’s (CBSA) implementation of eManifest eHouse BL (eHBL) filing initiative for Freight Forwarders/NVOCC’s becomes effective on January 4, 2021 (Customs Notice 20-28). On this date, a 6-month period of informed compliance and zero-rated penalties begins.
The eManifest is an initiative by CBSA aimed to enhance cross border commercial processes and represents the third phase of the Advance Commercial Information (ACI) program. Under the eHBL program, advance secondary data must be transmitted by the Freight Forwarder/NVOCC for cargo imported into, or moving in-transit through Canada, 24 hours prior to loading of cargo at a foreign port.
The eManifest preparations date back to 2016-2017, and more recently re-announced in early 2021, where CBSA launched the import BL filing requirement, however due to CBSA system enhancements the implementation was postponed.
New timeframe for eManifest requirement
- November 1, 2020: CBSA promotes eManifest test filing that allows system enhancements to address eManifest eHBL issues.
- Beginning January 4, 2021: eManifest filing is mandatory and there will be a six month informed compliance period and zero-rated penalties will be assessed.
- Early July, 2021: Non-compliance of eManifest filings are expected to be assessed monetary penalties according to CBSA regulations.
