Customer Advisory: Sri Lanka – Advisory on recent changes to regulations 2041/10 and 2302/24

On March 2, 2023, the Minister of Ports, Shipping and Aviation in Sri Lanka announced a revision to the Licensing of Shipping Agents, Freight Forwarders, Non-Vessel Operating Common Carriers and Container Operators Act No 10. of 1972 by rescinding former regulations 2041/10 and 2302/24 (the “Rescinded Regulations”).

The main requirements of the Rescinded Regulations were:

  • Service providers were required to issue a clean bill of lading.
  • Service providers were not permitted to specify any bill of lading as ‘zero freight’.
  • Service provider charges on containerized cargo were required to be ‘all-inclusive freight’ (including THC, BL charges)
  • For imports into Sri Lanka, the service providers were permitted to charge a ‘delivery order’ fee as prescribed by the Authorities (Director of Merchant Shipping)

These requirements have now been rescinded and no longer apply.

Customers are advised to check directly with their contracted carriers to find out whether they will be adjusting their charging structure as a result, and if so inform us immediately if we need to change any existing invoicing/payment arrangements.
